Does a misdiagnosis constitute medical malpractice?

When people think about medical malpractice, they usually think of a medical procedure that was performed wrong in some way that has caused someone even more health issues than they originally suffered from. While this certainly does constitute medical malpractice, you may be surprised to learn that there are other forms as well. One such type of medical malpractice comes in the form of failed or erroneous diagnosis. A medical professional prescribing the wrong treatment can cause serious harm later on, and could be the basis for a medical malpractice case.

A failed diagnosis can have many negative effects on one’s health. If a doctor prescribed an erroneous treatment, you will still be suffering the effects of your actual health problem, which will continue to cause issues as it is further exacerbated. Alternatively, the diagnosis could cause a severe health concern that you otherwise would not have had to face. For example, if a doctor misdiagnoses you with an illness, claiming that your best option is to have a limb surgically amputated, you could learn later that you didn’t have to give up that limb after all.

Another form of misdiagnoses that you could encounter would be a lack of treatment for your particular health concern. This happens when a doctor correctly identifies your health problem, but doesn’t prescribe enough treatment, prescribes the wrong treatment or prescribes an inefficient treatment.
