Getting medical treatment after a workplace injury

If you have been injured in the workplace in the state of New York, like many other injured workers you may be wondering about your rights to medical treatment and compensation. Workers' compensation policies can seem overwhelming and confusing at first, and this is why it is important to have a brief overview before proceeding with further medical services.

It is important that you verify whether you are entitled to workers' compensation. The vast majority of employees are entitled to this by law. You should additionally remember that if you are entitled to workers' compensation, you will be able to make a claim regardless of whether the incident was deemed to be a fault of yours or not.

As long as you were injured while performing work-related duties, you will be able to make a claim. The following are some common questions asked about gaining medical treatment after an injury in a New York workplace.

Will I be able to choose which doctor I see?

Whether you will be able to see your doctor of choice will depend on the type of workers' compensation your employer has. If your employer uses a managed care program, you will have to choose a medical care provider within a list.

Will I be out-of-pocket as a result of paying for medical care after an injury?

You may have to pay for some medical services and supplies up front, such as prescriptions, for example. However, as long as you keep a comprehensive record of the supplies related to your injury that you are paying for, you will be able to gain reimbursement for this.

What types of medical treatments can I be compensated for?

You can be compensated for any types of medical treatment that are considered necessary or appropriately related to your injury. For example, you may be able to gain compensation for therapy or counseling sessions if you struggled emotionally in the aftermath of the accident.

If you have suffered financially or physically as a result of an injury in the workplace, it is important that you know your rights and take action to make a claim.
