Taxicab Accidents

Many accidents in New York City involve taxicabs. If you were a passenger in the cab, it can be difficult to determine whose insurance company is responsible for paying your damages and how much coverage is available.

At Godosky & Gentile, our lawyers are experienced in dealing with complex insurance issues. We represent taxicab passengers as well as pedestrians, bicyclists and other drivers in the New York City area who were struck by taxies. We offer a free case evaluation to discuss your case.

Who Pays For My Losses?

New York taxicabs are required to carry no-fault insurance. That insurance will pay for a certain amount of damages regardless of who was at fault. If you have suffered a serious injury, however, you are likely to have losses that exceed the no-fault limits.

Once the taxicab’s no-fault insurance is exhausted, you may be entitled to seek compensation from the taxicab company’s liability insurance, the insurance of the other driver or both. The amount of insurance varies according to the type of taxi service.

Licensed limousines and taxi services in New York City are required to carry a minimum of $100,000 in liability insurance for one person and $300,000 for all persons injured in one accident. Unfortunately, unlicensed or gypsy cabs may carry as little as $25,000 for one person and $50,000 for all persons injured in one accident. Uber ride-sharing drivers have $1 million in liability coverage.

If you are a passenger in a taxi that was struck by another vehicle, our lawyers can also seek compensation from the other driver’s insurance if he or she was at least partially at fault.

What If The Insurance Company Denies My Claim?

We are always happy to help.

The taxicab may deny your claim if you were not wearing a seat belt or if you stepped out of the cab into traffic. Our lawyers will fight for compensation if the taxi driver or other party was also negligent.

We can help you consider whether you should accept an insurance company settlement.
